Tax compliance becomes significantly more challenging when you venture beyond routine scenarios. HMRC’s newly released Guidelines for Compliance 13 (GfC13) provides clarity on their expectations when taxpayers encounter complicated or ambiguous tax matters.

Understanding the scope

These guidelines don’t apply to routine tax affairs where the rules are well-established. Instead, they target situations characterised by legal ambiguity or unprecedented circumstances.

The guidelines become relevant when you’re:

  • Implementing strategies that lack judicial precedent
  • Facing genuine uncertainty about correct tax treatment after thorough research

HMRC draws a clear distinction between “novel” positions (untested by courts) and “improbable” ones (likely to fail judicial scrutiny). They strongly discourage filing returns based on positions you believe courts would reject.

Available support mechanisms

When confronting genuine tax uncertainty, HMRC outlines several available resources. Non-statutory clearance applications may be appropriate in certain circumstances, whilst professional consultation remains a viable option – provided you engage qualified advisers and supply complete factual information.

However, obtaining professional advice doesn’t transfer responsibility. You remain accountable for your return’s accuracy regardless of external opinions received.

Managing persistent uncertainty

Occasionally, thorough investigation fails to resolve tax ambiguities entirely. HMRC requires disclosure of such uncertainties when filing returns, including:

  • Taxpayer identification details and unique reference number
  • Comprehensive issue description
  • Applied interpretation details
  • Impact on tax calculations

Self-assessment returns should include this information in the designated “white space” area, whilst corporation tax submissions require inclusion within computations or supporting documentation.
